Uncontested Divorce

New York encourages spouses seeking a divorce to work out their own agreements regarding asset distribution, child custody, child visitation, and other matters pertaining to the marriage.  When the parties agree on all these matters, the divorce is called an uncontested divorce. An uncontested divorce can save the divorcing couple the significant costs of a trial.

Once an agreement is worked out, it is signed by both spouses, and submitted to the court for approval and inclusion in the final settlement.

An uncontested divorce can be concluded within six weeks to four months after the paperwork is filed with the court.  If a spouse disagrees with the divorce or there is a dispute regarding an agreement that can't be resolved, the matter will be referred to the court for adjudication.  Our firm can provide capable legal assistance in such a divorce and help you avoid a lengthy trial.

Contested Divorce

When the parties are unable to agree on all the necessary terms, including asset distribution,  support, and custody; the divorce becomes contested. Because a contested divorce is a litigation, each party will require an attorney. Understandably, when the parties disagree, the process will be longer and more expensive than an uncontested divorce.
